Dfrktn does not commit to using an alternative dispute resolution entity to resolve disputes.
You will receive an order confirmation including a link to these Terms of Trade via email once your purchase is complete.
These terms of trade are governed by Belgian Law
By placing an order through our website, you confirm that you have reviewed and accepted the pre-contractual information and Terms of Trade in a language you understand.

The below terms and conditions apply to all direct-to-consumer sales through our website www.dfrktn.com. Purchases through other websites or channels are subject to the terms and conditions of their respective operators.
All prices listed on the website are in Euro and show both the VAT-included and VAT-excluded amounts.

Items for which the price is not listed only receive a fixed price when an offer is made.

Shipping

Your order will be dispatched on regular working days, Monday to Fridays. Dfrktn works with Bpost for all online purchases. If you wish to use a different courier or shipping method, please contact info@dfrktn.com.

Please note that all delivery timings are indicative and depend on our shipping partner. Deliveries may also take a little longer during sales periods and public holidays.

Prices do not include delivery charges which will be confirmed to you at the time of purchase (on our website or via email). The following shipping costs can act as a non-binding estimate:

Domestic Shipping (within Belgium):€ 9.85 - 12.65
Shipping to within the European Union: € 13.75 - 54.30
Shipping outside the EU: € 31.90 - 77.60
Free shipping for orders above € 700

If we are unable to deliver the ordered goods, or if we foresee long delays, you will be notified and have the right to cancel the order. If any payment has been made in advance, your money will be refunded as soon as possible within 30 days.

All products are packaged with the utmost care to ensure safe delivery.
Please note that for shipments outside the EU, there may be customs fees and handling costs to be paid separately. You will be responsible for these charges.

Legal Guarantee

All products sold by Dfrktn, including artisanal, handmade, and demi-couture clothing, are subject to the statutory guarantee of conformity for a period of two years from delivery. This guarantee covers manufacturing faults, material defects, or any substantial difference between the delivered product and its provided description. Due to the handmade and artisanal nature of our products, variations in colour, size, weave, and finish are considered normal and do not constitute grounds for claiming a lack of conformity. The guarantee does not cover damages arising from improper handling, washing, misuse, accidental damage, or natural wear and tear.

If a demi-couture item is defective or materially non-conforming to the information provided at time of purchase, please contact us within 14 days of receipt. We will assess and when relevant offer a repair, replacement, or refund in accordance with your statutory rights.

Demi-Couture Orders

Demi-couture pieces are individually crafted, made-to-order items that are customised to a client’s specifications. Due to their personalised nature, the following terms apply:

No Cancellations or Returns: Once production has started, orders cannot be cancelled, modified, or returned unless the item is defective or incorrect due to our error.
Customer Measurements & Alterations: The client is responsible for providing accurate body measurements. Dfrktn is not liable for garments that do not fit due to incorrect measurements provided by the customer. Adjustments can be made at an additional cost.
Non-Refundable Deposits: A 50% non-refundable deposit is required before work begins. The balance must be paid before shipping.
Production Timeline: Depending on their complexity and the capacity of our atelier, demi-couture pieces may require a longer production period. Estimated delivery times will be communicated at the time of purchase.

Force Majeure and Production Delays

All demi-couture pieces are individually handcrafted, and their timelines depend on atelier capacity, the availability of rare materials, and artisanal processes.

In the event of force majeure — including but not limited to illness of the lead maker, delays in sourcing vintage or deadstock fabrics, natural disasters, or other unforeseen events beyond our reasonable control — Dfrktn reserves the right to extend the production and delivery timeline.

Should a delay occur, we will notify you promptly with a revised estimate. If the delay exceeds 6 weeks beyond the original timeframe, you may choose to:

Accept the revised delivery schedule, or
Cancel the order and receive a full refund of any amounts paid, including the deposit.

These provisions apply only in the case of delays caused by force majeure. Regular variations in artisanal production times do not constitute grounds for cancellation.

Limitation of Liability

To the fullest extent permitted by law, Dfrktn (Shalima BV) shall not be liable for:

Any indirect, incidental, or consequential damages arising from the use, misuse, or inability to use our products;
Any variations in colour, texture, or fit resulting from the artisanal nature of the materials and processes used;
Damage caused by improper handling, washing, storage, or use of the product beyond its intended purpose.

For demi-couture and made-to-order items, Dfrktn is not liable for fit issues arising from inaccurate measurements supplied by the customer. Adjustments may be offered at an additional charge.

In all cases, our total liability shall not exceed the amount actually paid by the customer for the item in question.

Nothing in these terms limits your statutory rights as a consumer under applicable Belgian and EU law, including your right to repair, replacement, or refund in the case of defective goods.

Right of Withdrawal (Returns & Cancellations)

You have the right to withdraw from your purchase within 14 calendar days of receiving your order, except for demi-couture and personalised items.

To return a product, please email info@dfrktn.com and return the item within 14 days of notifying us to:

Return shipping is at the customer's expense unless the item is defective.

Refunds will be processed within 14 days of receipt and inspection.

Exceptions to the Right of Withdrawal:

Demi-couture & bespoke items (non-returnable unless defective).
Gift cards & discounted items clearly marked as final sale.

For ready-to-wear items, returns must be unworn, in original condition, and with tags attached.

Payments

Payments can be made via major credit cards, or bank transfer.
For bank transfers, please email us on info@dfrktn.com for instructions.
All charges related to bank transfers are the responsibility of the customer.
We reserve the right to cancel orders or request additional verification if payment irregularities are detected.

Tax-Free Purchases

All purchases being shipped out of the EU zone are exempt from value-added tax.
